How far back can HMRC assess customs duty?
HMRC can assess additional customs duty going back three years from the date of the
original declaration. Where deliberate non-compliance is found, there is no time limit on assessment. This is why proactive compliance reviews — identifying and correcting errors before HMRC does — are important for UK importers.
What happens if I use the wrong commodity code?
Using the wrong commodity code can result in underpaid duty — creating a liability
HMRC can assess with interest — or overpaid duty, which you may be able to reclaim through amended declarations. HMRC can also impose civil penalties where misclassification is found to be deliberate or careless. A post-clearance amendment is available where errors are identified and corrected proactively.
What is postponed VAT accounting and should I use it?
Postponed VAT Accounting (PVA) allows UK VAT-registered importers to account for import VAT on their VAT return rather than paying it at the border. This avoids the cash flow disadvantage of paying VAT upfront and waiting to reclaim it. If you are VAT-registered and importing goods regularly, PVA should almost certainly be elected — it is straightforward to
implement and the cash flow benefit is immediate.
Do I need a customs agent to import goods into the UK?
No, you can make customs declarations yourself if you are registered on HMRC&
Customs Declaration Service (CDS). However, the process is complex and errors are common. Many UK businesses use a customs agent or consultant to manage declarations on their behalf, particularly for high-value or high-volume imports where errors are costly.
